The end-user license agreement (EULA) are a contractual document between the publisher of a website and visitors to the site. Their role is to set the terms of use of the site and to delimit users’ rights. They are aimed at each Internet user who visits the site. The general conditions of use have the value of a contract; once the user accepts them, he is deemed to have consented to their entire content, exactly as if he had signed a contract.
Preamble
These general conditions of use are concluded between:
– the manager of the website, hereinafter referred to as “the Editor”,
– any person wishing to access the site and its services, hereinafter called “the User”.
Article 1 – Principles
The purpose of these general conditions of use is to provide a legal framework for the use of the COMEP site and its services.

Theend-user license agreement must be accepted by any User, and their access to the site constitutes acceptance of these conditions.
Article 2 – Evolution and duration of the EULA
These general conditions of use are concluded for an indefinite period. The contract produces its effects with regard to the User from the start of use of the service. The COMEP site reserves the right to modify the clauses of these end-user license agreement at any time and without justification.
Article 3 – Access to the site
Any User with access to the internet can access the COMEP site free of charge and from anywhere. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not the responsibility of the Publisher.
The site and its various services may be interrupted or suspended by the Publisher, particularly during maintenance, without obligation to give notice or provide justification.
The User of the site has access to the following services: sale of furniture and decoration.
Article 4 – Responsibilities
The Publisher cannot be held liable in the event of a failure, breakdown, difficulty or interruption of operation, preventing access to the site or one of its functionalities.
The site connection equipment used is the entire responsibility of the User who must take all appropriate measures to protect the equipment and data, in particular from viral attacks via the Internet. The user is also solely responsible for the sites and data he consults.
The Publisher cannot be held responsible in the event of legal proceedings against the User:
– due to the use of the site or any service accessible via the Internet;
– due to the User’s non-compliance with these general conditions.
Article 5 – Intellectual property
All technical documents, products, photographs, texts, logos, drawings, videos, etc., are subject to copyright and are protected by the Intellectual Property Code. When they are given to our clients, they remain the exclusive property of COMEP, the sole owner of the intellectual property rights to these documents, which must be returned to it upon request.
Our customers undertake not to make any use of these documents which could infringe the industrial or intellectual property rights of the supplier and undertake not to disclose them to any third party, apart from express and prior authorization given by the Editor.
Article 6 – Hyperlinks
The establishment by the User of any hypertext links to all or part of the site is strictly prohibited, without prior written authorization from the Publisher, requested by email to the following address: comep@comep.nc.
The Publisher is free to refuse this authorization without having to justify its decision in any way. In the event that the Publisher grants its authorization, this is in any case only temporary and may be withdrawn at any time, without any obligation to provide justification on the part of the Publisher.
In any case, any link must be removed upon simple request from the Publisher.
Any information accessible via a link to other sites is not under the control of the Publisher who declines all responsibility for their content.
Article 7 – Cookies
The COMEP site may automatically collect standard information. Any information collected indirectly will only be used to track the volume, type and pattern of traffic using this site, to develop the design and layout and for other administrative and planning purposes and generally to improve the service that we offer you.
Article 8 – Applicable law
These end-user license agreement are subject to the application of French law. If the parties are unable to resolve a dispute amicably, the dispute will be subject to the jurisdiction of the courts of New Caledonia.
